Terms and Conditions of Use

"The Terms of Use delimits the responsibility and directs how its customers must use its product and, according to Law No. 12.965/2014, it must contain rules of conduct for the use of the platform, any prohibitions, access conditions, protection of intellectual property of the business and even the responsibilities of each one who uses it. 1 PRESENTATION

Welcome to Mirava!

 

You agree that by clicking “Sign up now”, “Sign up with Mirava”, “Sign up” or similar, by registering, accessing or using our services (described below), you agree to enter into a contract legally binding with Mirava (even if you are using our Services on behalf of a company). If you do not agree with this agreement (“Agreement” or “User Agreement”), please do not click on “Sign up now” (or similar) and do not access or use any of our Services. If you wish to terminate this agreement, you may do so at any time by closing your account and no longer accessing or using our Services.

2 SERVICE

This Agreement applies to Mirava, the branded apps, apps, communications and other services related to Mirava that they claim to be offered under this Agreement (“Services”), including external collection of data for those Services, such as our advertisements and the “Apply for Mirava” and “Share on Mirava” plugins. People registered in our Services are “Users” and those not registered are “Visitors”.

3 HOW OUR SERVICES ARE FINANCED

Instead of paying for the use of Mirava, using the service provided in these terms, you acknowledge that we may show you advertisements that companies and organizations pay us to promote within and outside of Mirava company's products. We use your personal data, such as information about your activities and interests, to show you more relevant ads.

 

We show useful and relevant ads without advertisers knowing who you are. 

We allow advertisers to tell us, for example, their business goal and the type of audience they want to reach with the ad. Then we show the ad to people who might be interested.

 

We also provide advertisers with reports on ad performance to help them understand how people are interacting with content inside and outside Mirava. For example, we provide demographics and general interest information to advertisers to help them better understand their audience.

 

There are also paid services such as the “Premium Plan” which is a service of the Mirava application, in which various benefits will be made available.  and “Premium Communities” which are exclusive conversations with important subjects only for customers who pay to join the chat.

 

If you purchase any of our paid services (“Premium Plan”, “Premium Communities”), you agree to pay us applicable fees and taxes. Failure to pay these fees will result in termination of your paid services. In addition, you agree that:

 

  • Your purchase may be subject to exchange rates or price differences based on location (for example, currency exchange rates).

  • We may store and continue to charge your payment method (eg, credit card) even after it has expired, to avoid interruptions to your services and to use it to pay for other services you may purchase.

  • If you purchase a subscription, your payment method will be automatically charged at the beginning of each subscription period for applicable fees and taxes.​​ to that period. To avoid future charges, cancel before your renewal date.

  • We may calculate taxes payable by you based on the billing information you provide to us at the time of purchase.

  • You can get a copy of your invoice through the Mirava account settings under “Purchase History”.

4 COMMITMENTS TO OUR PLATFORM

In return for our commitment to provide the Service, we require that you commit to the following.

Who can use the Mirava. We want our Service to be as open and inclusive as possible, but we also want it to be safe and compliant with the law. That's why we need you to commit to some restrictions to be part of the Mirava community.

  • You must be at least 18 years old or the minimum legal age in your country to use Mirava.

  • You may not be prohibited from receiving any aspect of our Service under applicable law or engaging in payments relating to the Service if your name is on a list of unauthorized third parties.

  • Your account cannot have been deactivated by us for violation of the law or any of our policies.

  • You cannot have been convicted of a sex crime.
     

  • You cannot be banned from medical advice.

Providing an open and secure Service to a wider community requires all of us to do our part.

  • You may not impersonate other people or provide inaccurate information.

  • You do not need to reveal your identity on Mirava, but you must provide us with up-to-date and accurate information (including registration information), which may include personal data. Also, you must not impersonate anyone or anything you are not, and you may not create an account for someone else unless you have their express permission.

  • You may not do anything that is unlawful, misleading, fraudulent or for an illegal or unauthorized purpose.

  • You may not violate (or help or encourage others to violate) these Terms or our policies.

  • You may not do anything that interferes or affects the intended operation of the Service.
    This includes misusing any whistleblower, challenge or appeal channel. For example, making fraudulent or unsubstantiated complaints or appeals.

  • You may not do anything that interferes or affects the intended operation of the Service.
    This includes creating accounts or collecting information in an automated way without our express permission.

  • You may not sell, license or purchase any accounts or data obtained from us or our Service. This includes attempting to buy, sell or transfer any element of your account (including your username), requesting, collecting or using other users' login credentials or seals, requesting or collecting Mirava usernames and passwords, or appropriating improperly of access tokens.

  • You may not post another person's private or confidential information without permission or do anything that violates another person's rights, including intellectual property rights (eg, copyright infringement, trademark infringement, counterfeiting or pirated goods) .

  • You may use content created by another person subject to the copyright and related rights exceptions and limitations under applicable law.

  • You represent that you own or have obtained all necessary rights to the content you post or share. Learn more, including how to report content that you believe infringes your intellectual property rights, here .

  • You may not modify, translate, create derivative works or reverse engineer our products or their components.

  • You may not use a domain name or URL in your username without our prior written consent.

As part of our agreement, you also grant us necessary permissions to provide the Service.

  • We do not claim ownership of your content, but you grant us a license to use it.
    Nothing changes regarding your rights to its content. We do not claim ownership of your content that you post on or through the Service. Plus, you're free to share your content with anyone else, wherever you want. However, we do require that you grant us certain legal permissions (known as a “license”) to provide the Service. When you share, publish or upload content protected by intellectual property rights (such as photos or videos) on or in connection with our Service, you grant us a non-exclusive, free, transferable, sublicensable and valid worldwide license to host, use, distribute , modify, serve, copy, publicly display or perform, translate, and create derivative works of your content (consistent with your privacy and application settings). This license will terminate when your content is deleted from our systems. You can delete content individually or all content at once by deleting your account.
     

  • Permission to use your username, profile picture, and information about your relationships and actions with accounts, advertisements, and sponsored content.

  • You grant us permission to display your username, profile picture, and information about your actions (such as likes) or relationships (such as accounts you follow) alongside or related to accounts, advertisements, offers, and other sponsored content you follow or with which you interact, that are displayed, without payment of any remuneration to you. For example, we may show that you liked a sponsored post created by a brand that paid us to run ads. In the same way as taking actions on other content and following other accounts, taking actions on sponsored content and following sponsored accounts are acts that can only be seen by persons with permission to view or follow such content. We will also respect your ad settings.

  • You agree that we may download and install updates to the Service on your device.

5 RIGHTS AND LIMITS

Pursuant to the agreement between you and Mirava, you are the owner of the content and information that you submit or publish on the Services, and you are only granting Mirava the following non-exclusive license:

An international, transferable and sub-licensable right to use, copy, modify, distribute, publish and process the information and content you provide through our Services and third-party services, without any other consent, notice and/or compensation to you or third parties. These rights are limited in the following ways:

  1. You may terminate this license for specific content by deleting content from the Services or generally by terminating your account, except (a) to the extent that you have shared the content with third parties as part of the Service and they have copied, shared or stored it. and (b) during the period necessary to remove it from the backup and other systems.

  2. We will not include your content in advertisements for third-party products and services without your explicit consent (including Sponsored Content). However, we do have the right, without payment to you or third parties, to post advertisements alongside your content and information, and your social actions may be displayed and included in advertisements as described in the Privacy Policy. If you use a Service feature, we may mention it with your name or photo to promote the feature on our Services in accordance with your settings.

  3. We will obtain your consent if we wish to provide third parties with the right to publish your content outside of our Services. However, if you choose to share your post as “Public, All or Similar”, we will provide a feature that allows other Users to embed the public post in third-party services and enable search tools to make the content public and searchable through services of these third parties.

  4. Although we may edit and change the formatting of your content (such as translating or transcribing it, modifying its size, layout or file type, or removing metadata), we do not change the meaning of your expression.

 

You and Mirava agree that we may access, store, process and use any information and personal data you provide in accordance with the terms of the Privacy Policy and your choices (including settings).

By submitting suggestions and other feedback related to our Services to Mirava, you agree that Mirava may use and share (but has no obligation to do so) such feedback for any purpose, without compensation to you.

5.1 Service Availability

We may change, suspend or discontinue any of our services. We may also change our prices prospectively upon reasonable notice, to the extent permitted by law.

We do not undertake to store or continue to display information or content published by you. Mirava is not a storage service. You agree that we are under no obligation to store, maintain or provide you with a copy of content or information that you or third parties provide, except to the extent required by applicable law and as indicated in our Privacy Policy.

5.2 Limits

Mirava reserves the right to limit your use of the Services, including the number of your connections and your ability to interact with other Users. Mirava reserves the right to restrict, suspend or terminate your account if you violate this Agreement or the law or misuse the Services (for example, violating any of the items set out in the section “What is permitted or prohibited in the Aimed.  

5.3 Intellectual Property Rights

Mirava reserves all intellectual property rights in the Services. Trademarks and logos used in connection with Mirava are trademarks of their respective owners.

6 TERMINATION

Mirava and you may terminate this agreement at any time without notice. Upon termination, you lose the right to access and use the Services. The following will survive termination:

  • Our rights to use and disclose your feedback;

  • The rights of Users and/or Visitors to share content and information you have shared through the Services;

  • Any amounts due by either party prior to termination will continue to be due after termination.

7 WHAT IS PROHIBITED AND PERMITTED AT MIRAVA

Mirava is a community of professionals. This list of what is allowed or prohibited, along with our Policies for Professional Communities, limit what you can and cannot do in relation to our Services.

7.1. What you should do

You agree that you will:

  • Comply with all applicable laws, including but not limited to privacy laws, intellectual property laws, anti spam laws, export control laws, tax laws and regulatory requirements;

  • Provide accurate information to us and keep it up to date;

  • Use your real name in your profile; 

  • Use the services in a professional manner.

  • Act impartially on scientific topics

7.2. what not to do

You agree that you will not:

  • Create a false identity on Mirava, post incorrect information on your profile, create a User profile for someone other than you (an individual), or use or attempt to use someone else's account;

  • Develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, plugins and add-ons for browsers or any other technologies) to scan the Services or otherwise copy profiles and other data from the Services;

  • Neutralize any security features or circumvent or cancel any access controls or limits on the use of the Service (such as maximum keyword limits or profile views);

  • Copy, use, disclose or distribute any information obtained from the Services, directly or through third parties (such as research tools), without the consent of Mirava;

  • Disclose information that you are not authorized to disclose (such as confidential or other information (including that of your employer);

  • Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other protected rights. Example: do not copy or distribute (except through the sharing functionality available) third-party publications or other content without permission, which may be granted upon publication under the terms of a Creative Commons license;

  • Violate Mirava's intellectual property rights or other rights, including but not limited to: (i) copying or distributing our learning videos or other materials; (ii) copy or distribute our technology unless licensed under open source licenses; or (iii) use the word “Mirava” or our logos in any trade name, email or URL, except as provided in the Brand Guidelines;

  • Post content that contains software viruses, worms or any other harmful code;

  • Reverse engineer, decompile, disassemble, decrypt or otherwise attempt to extract the source code for the Services or any related non-open source technology;

  • Insinuating or claiming that you are affiliated with or endorsed by Mirava without our express consent (for example, presenting yourself as an accredited Mirava trainer);

  • Rent, assign, lend, market, sell/resell or otherwise monetize the Services or related data or access thereto, without the consent of Mirava.

  • Create a deep link to our Services for any purpose, except to promote your profile or a Group on our Services, without Mirava's consent;

  • Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;

  • Monitor the availability, performance or functionality of the Services for any competitive purposes;

  • Engage in “framing”, “mirroring” or otherwise simulating the appearance or function of the Services;

  • Overlay or otherwise modify the Services or their appearance (for example, by inserting elements into the Services or removing, covering or obscuring an advertisement included in the Services);

  • Interfering with operation or placing an unreasonable load on the Services (eg, spam, denial of service attack, viruses, gaming algorithms); and/or violate the Professional Communities Policies or any additional terms relating to a particular Service that is provided when you register and begin using that Service and the terms where applicable.

8 COMMUNITY GUIDELINES

COVID-19: Community Guidelines Safeguards and Updates: As people around the world face this unprecedented public health emergency, we want to ensure that our Community Guidelines protect them from harmful content and new types of abuse related to COVID-19 . We are working to remove content that has the potential to contribute to real-world harm, including through our policies that prohibit harm coordination, the sale of medical masks and related products, hate speech, bullying, harassment and misinformation that contribute to harm. risk of imminent violence or physical harm. As the situation evolves, we continue to analyze content on the platform, assess discourse trends and interact with experts. We also provide additional policy guidance, where appropriate, to keep our community members safe during this crisis.

8.1 Brief Instructions

We want Mirava to remain an authentic and safe place for inspiration and expression. Help us to promote this community. Upload only your photos and videos, always doing so in accordance with the law. Respect everyone on Mirava, don't spam or post nudity.

 

8.2 Detailed instructions

Mirava is a reflection of our community of diverse cultures, ages and beliefs. We spend a lot of time thinking about different points of view to create an open and safe environment for everyone.

We've created the Community Guidelines for you to help us promote and protect this amazing community. By using Mirava, you agree to these guidelines and our Terms of Use. We are committed to following these guidelines and we hope that you will too. When limits are exceeded, the result can be content deletion, account deactivation, or other restrictions.

In some cases, we allow public awareness content that goes against our Community Guidelines if it is newsworthy and of public interest. We only do this after considering the value to the public interest against the risk of harm. We use international human rights standards to make these judgments.

  • Only share photos and videos that you have taken or that you have the right to share.
    As always, you are the owner of the content you publish to Mirava. Post authentic content and do not post anything you have copied or obtained from the internet without having the right to post. Learn more about intellectual property rights.

  • Post photos and videos suitable for a wide range of audiences.
    We know there are times when people may want to post nude images of an artistic or creative nature, but for various reasons we don't allow nudity on Mirava. This includes photos, videos and some digitally created content that shows sexual intercourse, genitals and close-up images of fully exposed buttocks. Some photos of female nipples are also prohibited, but photos in the context of breastfeeding, childbirth and postpartum times, health-related situations (eg, post-mastectomy images, breast cancer awareness or breast cancer confirmation surgeries gender), in addition to images as an act of protest, are allowed. Nudity in pictures of paintings and sculptures is also allowed.
    People like to share photos and videos of their kids. For security reasons, we may remove some images that feature nude or partially nude children. Even when content is shared with good intentions, it can be used by others in unexpected ways.
     

  • Promote sincere and meaningful interactions.
    To help us stop spam, please avoid collecting likes, followers or shares artificially. Also avoid posting repetitive comments or content or contacting people repeatedly for commercial purposes without their consent. Do not offer cash or cash gifts in exchange for likes, followers, comments or other engagement. Do not post content that involves, promotes, encourages, facilitates, or admits to offering, soliciting, or trading in false and misleading user ratings or ratings.
    It is not necessary to use your real name on Mirava, but we do require Mirava users to provide us with accurate and up-to-date information. Do not impersonate another person or create accounts for the purpose of violating our guidelines or deceiving others.

  • Obey the law.
    Mirava does not accept the support or exaltation of terrorism, organized crime or hate groups. The offer of sexual services, the purchase or sale of firearms, alcohol and tobacco products between individuals and the purchase or sale of illicit or prescribed drugs (even if they are legal in your region) is also prohibited. Mirava also prohibits the sale of live animals between individuals. However, brick-and-mortar stores can make this type of ad. The organization of predatory hunting or the sale of threatened species or their parts is not allowed.
    Always comply with the law when offering to sell or buy other controlled products. Accounts that promote online gambling, online skill games for real money or online lotteries must obtain our written permission before using any of our products.
    We do not tolerate the sharing of sexual content involving minors or threats to post other people's intimate images.

  • Respect other members of the Mirava community.
    We want to promote a diverse and positive community. We remove content that contains real threats or hate speech, personal information with the intention of degrading or blackmailing someone, unwanted messages sent repeatedly and that attack private individuals with the intention of embarrassing or humiliating them. We generally allow strong discussions about people who are prominent in the media or who reach a wider audience because of their chosen profession or activities.
    Encouraging violence or attacking someone based on race, ethnicity, national origin, sex, gender, gender identity, sexual orientation, religion, disability or illness is never acceptable. When hate speech is being shared for the purpose of being fought or to raise awareness, we can allow it. In such cases, we ask that you clearly express your intentions.
    Real threats of harm to public and personal safety are not allowed. This includes both specific threats of physical harm and threats of theft, vandalism and other financial harm. We carefully review threat reports and consider several issues to determine whether a threat is real.

  • For our environment to be welcoming, don't exalt self-mutilation.
    The Mirava community cares about everyone. This is often a place where people facing difficult problems such as eating disorders, self-harm or other types of self-harm gather to raise awareness about the problem or find support. We try to do our part by providing educational content in the app and adding information to the Help Center so people can get the help they need.
    Encouraging or asking people to practice self-harm goes against this supportive environment. If this type of behavior is reported, we will remove the content or disable the accounts that post it. We may also remove content that identifies victims or survivors of self-harm if such content identifies people for attack or humor purposes.

  • Be careful when posting interesting events.
    We know that many people use Mirava to share important and interesting events. Some of these themes may involve explicit images. Many different people and different ages use Mirava. That's why we can remove videos of explicit and intense violence to ensure that Mirava remains an appropriate place for everyone.
    We understand that, in some cases, people share this type of content to condemn, raise awareness, or educate. If you share content for these reasons, write a caption warning of the presence of explicit images of violence. Sharing explicit images for sadistic pleasure or to glorify violence is not allowed.

Help us keep the community strong:

  • We are all an important part of the Mirava community. If you believe you have seen something that may violate our guidelines, please help us by using the built-in report option. We have a global team that reviews reports and works as quickly as possible to remove content that does not follow our guidelines. Even if you or someone you know doesn't have a Mirava account, you can file a report. When reporting, try to provide as much information as possible, such as links, usernames and content descriptions, so that we can find and review the content quickly. We may remove entire publications if images or associated captions violate our guidelines.

  • You may find content that you don't like but that doesn't violate the Community Guidelines. If this happens, you can unfollow or block the person who posted. If you don't like something about a comment in one of your posts, you can delete that comment.

  • Many discussions and misunderstandings can be resolved directly between community members. If any of your videos or photos were posted by someone else, you can try commenting on the post and ask the person to remove it. If that doesn't work, you can file a copyright infringement report. If you believe someone is violating your trademark rights, you can file a trademark infringement report. Do not attack the person who posted the content by sharing screenshots or drawing attention to the situation, as this can be classified as harassment.

  • We may work with law enforcement authorities, including when we believe there is a risk of physical harm or a threat to public safety.

 

 

8.3 Removing Content and Deactivating or Closing Your Account

  • We may remove any content or information you share on the Service if we believe such content violates these Terms of Use or our policies (including our Mirava Community Guidelines) or we are authorized or required by law to do so. We may refuse to provide or immediately stop providing all or part of the Service to you in order to protect our services or our community, or if you create legal risk or exposure to us, violate these Terms of Use or our policies (including our Guidelines Mirava Community), repeatedly violate the intellectual property rights of other people or in the event of permission or legal requirement to do so. We may also terminate or change the Service, remove or block content or information shared on the Service, or stop providing all or part of the Service if we determine that this is reasonably necessary to avoid or reduce adverse legal or regulatory impacts to us. If you believe that your account has been closed in error, or if you would like to permanently disable or delete your account, please visit our Help Center. When you request to delete content you've posted or delete your account, the process starts automatically within 30 days of your request. Content may be deleted within 90 days after the deletion process begins. Although the process of deleting certain content has already started, the content is no longer visible to other users, but it remains subject to these Terms of Use and our Data Policy. Once content is deleted, it may take another 90 days to remove it from our backup and disaster recovery systems.

  • Content will not be deleted within 90 days after the start of the account or content deletion process under the following circumstances:

    • if your content has been used by other people under this license, and they have not deleted it (in which case, the license will continue to apply until that content is deleted); or

    • if the deletion cannot occur within 90 days due to technical limitations of our systems. In that case we will complete the deletion as soon as technically possible; or

    • whether exclusion would restrict our ability to:

      • investigate or identify illegal activity or violations of our terms and policies (for example, to identify or investigate the misuse of products or systems);

      • ensure the protection of our products, systems and users;

      • comply with a legal obligation, such as the preservation of evidence; or

      • respond to a request from a judicial or administrative authority, law enforcement or a government agency.

    • In this case, the content will only be kept for as long as necessary for the purposes for which it was retained (the exact duration varies on a case-by-case basis).

  • If you delete your account or we deactivate it, these Terms will lead to the dissolution of the agreement between you and us. However, this section and the section below entitled “Our Agreement and What Will Occur in the Event of Disagreement” will still apply even after your account is closed, deactivated or deleted.

9 TERMS UPDATE

We may change our Service and our policies, and we may need to change these Terms so that they accurately reflect our Service and our policies. Unless otherwise stipulated by law, you will be notified (for example, through our Service) before we change these Terms and will have the opportunity to review them before they become effective. Therefore, if you continue to use the service, you will be bound by the updated terms.
